Firing my divorce lawyer…will it switch court systems in ny?
July 11th, 2010I'm now 000 into my divorce lawyer who has only "gotten" me 00/mo in child & spousal support. My ex's parents are paying for his cheap family-friend lawyer, so he's loving the fact that I'm only getting more & more into debt (so there's NO way he'll settle). We live in NY and if I'm not mistaken, our case is in Supreme Court (not family/civil court). So, when I fire my lawyer b/c I can't afford him (& don't hire another one), will the case be automatically moved (& what changes) &/or will the judge look at me unfavorabley &/or will I have to represent myself &/or what else can happen? My ex is vindictive - won't pay support on time or the right amt of $, and I need an order for child care (which is separte in NY) b/c I work & he refuses. And how do I respresent myself when it comes to filing for child care/lack of support/"he refuses to buy me out of the house or sell" situations, etc? Any help would be great... Legal Aid is really hard to get a hold of.
We don't even have custody/visitation settled yet (but we've been following a verbal agreement). It's been going on for a year now.
