Friday, July 9th, 2010Our son has a sleeping disorder and is mentally retarded with an IQ below 70.Recently he left the house in the middle of the night and got into 12 cars.He took petty little things of intrest to him,nothing of any great value.Only one person signed a complaint,but he now has 12 felony burgulary charges.We have done an incompentency evaluation and he was diagnosed incompatent to stand trial.So now they want him to be sent to a mental institution so they can make him competent.This law could apply to someone with pyscological problems but there is no cure for mental retardation.Please help us we have only till Oct. 3 to come up with a defense.We live in Kansas.

How can I make my living will override my life insurance?
Wednesday, July 7th, 2010I have SGLI (Servicemember's Group Life Insurance), and I want everything I have/will earn to go to someone other than who I listed as beneficiaries.
My girlfriend will have my son in 4 months. So can I make it so that all my money goes to him when he's born if I die before then? And I can't contact the SGLI office, I want to write a will saying "If I were to die, I would like all my money/future monetary earnings to go to my son". Will this legally override who I put on my SGLI form?
In short I want everything to go to my son when he's born if I died before then and nothing to go to who I PREVIOUsly stated for all my money to go to. Will it be legal or will they say "Oh well he's not on the SGLI so these people get the money instead"?
So would it legally override what I put on my insurance forms?? I just want to make sure

Tuesday, July 6th, 2010My mother has it in her will that when she dies everything goes to her kids. Her home is mostly paid off. Should she put one of her kids on the mortgage with her before she dies? Or by just leaving it to "all" her kids is there going to be a bigger tax penalty to pay were we to sell it or take over the mortgage after her death?
I know its kind of a morbid question but we were just talking about it and wondering. Maybe one of you know what is the best path to take.
