I'm now 000 into my divorce lawyer who has only "gotten" me 00/mo in child & spousal support. My ex's parents are paying for his cheap family-friend lawyer, so he's loving the fact that I'm only getting more & more into debt (so there's NO way he'll settle). We live in NY and if I'm not mistaken, our case is in Supreme Court (not family/civil court). So, when I fire my lawyer b/c I can't afford him (& don't hire another one), will the case be automatically moved (& what changes) &/or will the judge look at me unfavorabley &/or will I have to represent myself &/or what else can happen? My ex is vindictive - won't pay support on time or the right amt of $, and I need an order for child care (which is separte in NY) b/c I work & he refuses. And how do I respresent myself when it comes to filing for child care/lack of support/"he refuses to buy me out of the house or sell" situations, etc? Any help would be great... Legal Aid is really hard to get a hold of.
We don't even have custody/visitation settled yet (but we've been following a verbal agreement). It's been going on for a year now.

Long story short, my grandma passed away on Sunday. She took her daughter off of her will about a month or so ago (long story, don't ask) and the people who inherit everything are my brother and I. The house is going to the state and the money from the house is paying for funeral arrangements. My aunt's daughter is texting me telling me that they are getting a lawyer so they can get into my grandmother's house and get some things. But if my brother and I are the only one's in the will, but the house is the state's, would that still be illegal or breaking and entering? I have an appointment with the people left in charge of my grandma's will on Friday so I will ask them then, but just wanting to get more insight on here first and googling more things. If you have other questions please ask, but also please keep an eye on this question for responses.
Wouldn't it only NOT be b&e if I gave them permission? Because I never said that they could. My mom had me save the texts so I can show my grandma's lawyer on Friday.

as a beneficiary of deceased parent with other parent still living I would like to get copy of either Living will or living trust without going through the lawyer who constructed document or the executor or trustee of said document. can I go through probate court for a copy of aforementioned document?

In this past Sunday's issue of Parade magazine, on page 8, it spoke about finacial security when you get older and how anyone can lose everything when someone is in a nursing home, or long term health care is needed. They offered a book called, "How To Protect You Fincial Security When You Get Older", it states you cannot get it at any bookstore, yu have to order it through the publisher. Just wondering if this is real, or a scam? Can an older individual lose everything, all their life savings, house, assets, etc? It also states how you cannot trust a living will. It also states what lawyers never tell you about protecting your will. Anyone know the true facts about it all in NY state?

Should my mother make an irrevocable living trust or is a will enough? Does the lawyer get 5% of the estate when he goes to probate? She owns her house and some stock. The probate should be a simple one.

she has pancreatic cancer and was diagnosed 3-4 mths ago. She has been having good and bad days but is now very weak, She doesn't have a living will, and everything is starting to look ugly, meaning my brother and other sisters are all fighting among themselves as far as my moms property. My oldest sister and brother and my mom are named owners of moms home. She has talked to me (i am the youngest) that she wants them to sign a quit cailm deed so the house can be only under her name. Then she wants to sell the house to one of the siblings and therefore distribute accordingly... Can this be done? My moms okay sometimes but is very forgetfull lately and will a lawyer want to draw up a will? If I become the executor can I choose which siblings get money? I knw it sounds mean but I have a sister that has been sooo mean to my mom all her life and all of a sudden she comes to see my mom telling her she has changed, yeah right shes a snake!!!I just dont want her in my moms living will...
mom wants to sell house to fam member then wants for money to be divided up among siblings there are 6 of us but I dont want one to get any $!

I understand that Kelle, but my grandma took her daughter out because everything is materialistic to her (my aunt, who nobody in my fam has ever met). She lives out of state, only called my grandma when she was in the hospital to ask who the house is going to, tried to sell the house right in front of my grandma, etc. Thus, she was taken out of the will.
